A new Public Procurement Act (Promulgated, SG No. 13 of 16.02.2016) and Regulations for Implementation of the Public Procurement Act (Adopted by Decree No. 73 of the Council of Ministers of 05.04.2016, Promulgated, SG No. 28 of 08.04.2016), which regulate the so-called “Buyer Profile”, have been in force since April 15, 2016.

Pursuant to Art. 42, para. 1 of the PPA, contracting authorities are obliged to maintain a buyer profile, which is a separate part of their electronic pages or another Internet address for which publicity is ensured.

In this regard, the entire information required by law, which concerns public procurements announced by the Bulgarian Ports Infrastructure Company, is published in this section “Buyer Profile”. The documents for each public procurement are separated into an electronic file. With the publication of the documents on the buyer’s profile, it is accepted that the interested parties, candidates and/or participants are notified of the circumstances reflected in them, unless otherwise provided for in the PPA.

According to the provisions of the PPA and the RIPPA, the following are published in the buyer’s profile in the form of electronic documents:

  1. all decisions, announcements and invitations related to the initiation, awarding, implementation and termination of public procurements;
  2. the documentation for public procurements, with the exception of cases where, for technical reasons or those related to the protection of information, it is not possible to ensure unrestricted, full and direct access by electronic means;
  3. the clarifications provided by the contracting authorities in connection with public procurements;
  4. the minutes and final reports of the committees for conducting the procedures;
  5. the public procurement contracts and framework agreements, including the annexes thereto;
  6. the supplementary agreements for amendments to public procurement contracts and framework agreements;
  7. the notices for collecting offers and invitations to certain persons;
  8. the opinions of the Public Procurement Agency in connection with the preliminary control exercised by it;
  9. the information under Art. 44, para. 3, item 1 of the PPA;
  10. the notice under Art. 43, para. 4 of the PPA;
  11. the notice under Art. 193 of the PPA.

The procedure and terms for publishing the documents in the buyer’s profile are determined in Chapter Four “Publicity and Transparency”, Section III “Buyer’s Profile” of the RIPPA.
