In connection with the prepared Environmental Assessment Report (EA) of the above-mentioned plan and pursuant to Art. 20, para. 2, item 5 of the Ordinance on the terms and procedure for carrying out an environmental assessment of plans and programs, we hereby inform you that

- General information about the draft General Plan
a) Basis for the preparation of the General Plan
The preparation of the plan is permitted by Joint Order No. RD-08-283/05.06.2023 of the Minister of Transport and Communications and RD-02-14-605/01.06.2023 of the Minister of Regional Development and Public Works.
b) Period of validity and stages of implementation of the General Plan
The forecast period of validity of the plan is 20 years, unless there are significant economic and other social changes. The project does not include implementation stages. Implementation will depend on future investment initiatives of SEPI and the current state operator or future concessionaire.
c) Territorial scope
Vidin-Center Port Terminal is located in the central urban part of Vidin, on the right bank along the Danube River from river km 789.900 to km 791.300, and is an existing specialized passenger terminal. The territorial scope of the General Plan includes port territory (six properties with identifiers 10971.501.412, 10971.502.204, 10971.502.839, 10971.502.917, 10971.502.918 and 10971.502.919) and port water area (the operational water area, the approach and maneuvering zones are the Danube River, as they fall within the scope of a property with identifier 10971.307.1).
d) Affected elements of the National Ecological Network /NEM/
The territory and water area of the port terminal do not affect elements of the National Ecological Network.
e) Main objectives of the General Plan
The General Plan for the development of the port is the necessary spatial basis for the construction, expansion and development of each port for public transport. It defines the concepts for the long-term development of the respective territory and water area.
The goal of the General Plan is to provide spatial opportunities for the implementation of the investment intentions of the Bulgarian state in port infrastructure (assets) – public state property (the Minister of Transport and Communications through SEPI), and of the state port operator with a view to – improving the conditions for processing passenger traffic, creating opportunities for new ship berths, as well as a general increase in the capacity of the port.
The task of the draft General Plan is, based on the technical and technological survey of the existing situation of the port for public transport and its infrastructure capacity, to argue the possibilities for future development and to propose substantiated solutions in accordance with the requirements of the MSPWWPRB and of Ordinance No. 10 on the scope and content, preparation, approval and amendment of the general plans of ports for public transport.
General goals:
- development and modernization of port infrastructure;
- development of tourism, creation of conditions for recreation and sports;
- facilitating and increasing transit through Bulgaria to and from the European Union and in the direction of the ports of the Danube Delta.
Specific goals:
- attracting private investment for the maintenance and development of port infrastructure and improving passenger service;
- creating conditions for increasing the number of passengers served, and above all cruise passengers, with the aim of developing tourism;
- implementation of environmental measures – a system for collecting waste from ships[1];
- increasing the level of safety and security;
- creating conditions for more efficient use of port facilities by expanding the scope and volume of services.
e) Financing of the General Plan
Financing is with state funds.
f) Deadlines and stages of preparation of the General Plan and the existence, legally regulated, of a requirement for public discussion or other procedural form for public participation
The General Plan is prepared in one stage, and there is no legally regulated requirement for holding a public discussion.

- General information about the proposed plan
a) Basis for the preparation of the plan
According to Order No. RD-08-410/21.10.2021 (MTITC) and No. RD-02-14-893/18.10.2021 (MRDPW), the draft General Plan of the Port for Public Transport Ruse is being prepared in accordance with the requirements of the current regulatory framework in the Republic of Bulgaria, including the requirements of the Law on Maritime Spaces, Inland Waterways and Ports of the Republic of Bulgaria and Ordinance No. 10 of 2014 on the scope and content, preparation, approval and amendment of the general plans of ports for public transport, and the approved assignment. When preparing the draft General Plan, the indicators (parameters) of construction comply with Ordinance No. 7 of 2003 on rules and regulations for the structure of individual types of territories and structural zones (promulgated, SG, No. 3 of 2004) and those provided for in the approved and effective spatial plans of a higher degree.
The draft General Plan takes into account the results of the implementation of the permit for the preparation of a draft detailed spatial plan – parcellation plan for the port water area, as part of the General Plan of the Nikopol Port Terminal of the Port for Public Transport Ruse, given by order of the Minister of Transport, Information Technologies and Communications and the Minister of Regional Development and Public Works No. RD-08-498 of November 14, 2018 (MTITC) and No. RD-02-14-1159 of November 12, 2018 (MRDPW). With regard to the territory, water area and land access infrastructure of the Svishtov and Somovit port terminals, the existing situation is reflected.
b) Period of validity and stages of implementation of the plan
The scope and content of the draft general plan comply with the requirements of Ordinance No. 10 of 31.03.2014 on the scope and content, preparation, approval and amendment of the general plans of ports for public transport.
The development of the General Plan of the Port for Public Transport Ruse is in direct connection and corresponds to higher-level plans such as the Integrated Transport Strategy of the Republic of Bulgaria until 2030[1] and the guidelines for the development of the trans-European transport network.
The Integrated Transport Strategy outlines the main directions for the development of the national transport system in the period up to 2030.
c) Territorial scope
The infrastructure of the Port of Public Transport Ruse, which is the subject of the current development, includes:
- Port Terminal Ruse – West, operated by the State Enterprise “Port Infrastructure”;
- Port Terminal Ruse – Center, operated by “Port Complex Ruse” EAD;
- Port Terminal Ruse-East – 2, operated by “Port Complex Ruse” EAD;
- Port Terminal Ruse-East – 1, operated by “Port Complex Ruse” EAD;
- Port Terminal Tutrakan, operated by “Port Complex Ruse” EAD;
- Ferry Terminal Silistra, operated by the State Enterprise “Port Infrastructure”;
- Port Terminal Silistra, operated by “Port Complex Ruse” EAD;
- Port Terminal Somovit, concessioned to “Octopus S” OOD;
- Port Terminal Nikopol, concessioned to “Navigation Bulgarian River Shipping” AD;
- Port Terminal Svishtov, concessioned to “Dredging Fleet – Istar” AD.
d) Affected elements of the National Ecological Network /NEM/
The territory and water area of the port terminals Ruse – West, Ruse – Center, Ruse – East – 1, Ruse – East – 2, Tutrakan, Silistra, Svishtov and the separated zone Ruse – East do not fall within the boundaries of protected areas within the meaning of the Protected Areas Act (PAA), as well as within the boundaries of protected zones within the meaning of the BDA.
The territory of the Silistra ferry terminal does not fall within the boundaries of a protected area, but borders the protected area BG0000534 “Chayka Island”, designated under Art. 6, para. 1, items 1 and 2 of the BDA for the conservation of natural habitats and wild flora and fauna, announced with Order No. RD-401/26.05.2020 of the Minister of Environment and Water (promulgated, SG, issue 55/2020), amended and supplemented by Order No. RD-1067/07.11.2022 of the Minister of Environment and Water (promulgated, SG, issue 90/2022). The water area of the terminal falls within the boundaries of the zone.
The territory and water area of the Nikopol port terminal fall within the protected area BG0000396 “Persina”, designated under Art. 6, para. 1, items 1 and 2 of the Biological Diversity Act for the conservation of natural habitats and wild flora and fauna, declared by Order No. RD-339/31.03.2021 of the Minister of Environment and Water (promulgated, State Gazette, No. 54/2021), amended and supplemented by Order No. RD-103 8/03.11.2022 of the Minister of Environment and Water (promulgated, State Gazette, No. 89/2022) and in the protected area BG0002074 “Nikopol Plateau”, designated for the conservation of wild birds under Art. 6, para. 1, items 3 and 4 of the Biological Diversity Act, declared by Order No. RD-841/17.11.2008 of the Minister of Environment and Water (promulgated, State Gazette, No. 108/2008), amended and supplemented by Order No. RD-80/28.01.2013 of the Minister of Environment and Water (promulgated, State Gazette, No. 10/2013) and Order No. RD-1043/03.11.2022.
The water area and territory of the Somovit port terminal do not affect protected areas and protected zones, but the terminal is located near the protected area BG0000181 “Vist River”.
Part of property with identifier 51723.500.1348 and part of property with identifier 51723.500.1347 according to the Cadastral Map of Nikopol, Nikopol Municipality, Pleven Region, representing the Nikopol port terminal, fall partially within the boundaries of Persina Nature Park (PP), announced with Order No. RD-684/04.12.2000 of the Minister of Environment and Water (promulgated, SG, issue 105/2000), amended by Order No. RD-771/24.09.2020 of the Minister of Environment and Water (promulgated, SG, issue 12/10.02.2020). According to the Management Plan of Persina Nature Park, adopted with Decision No. 287/11.04.2012 of the Council of Ministers (promulgated, SG, issue 31/2012) and Decision No. 77/11.02.2016 of the Council of Ministers, these territories fall within zone III “Sustainable Use Zone”.
e) Main objectives of the plan
The objectives of the General Plan are determined by the Design Assignment and are reduced to:
- Opportunities for the development of existing port activities and services with optimization of the areas in which they are carried out;
- Improvement of transport, technological, infrastructure projects related to the organization of port activities;
- Making informed decisions on the navigational support of the port water area – boundaries and design depths;
- Finding generalized parameters for future investment initiatives for the construction of new open and closed warehouses, new warehouses for specific cargo, new parking lots, waiting areas, administrative buildings with offices.
- Reflection and creation of a basis for the implementation of current initiatives and plans, such as the installation and commissioning of port reception facilities for waste.
e) Financing of the plan
The financing for the implementation of the General Plan of the Port of Public Transport Ruse is foreseen with own funds of the State Enterprise “Port Infrastructure” – Sofia with granted rights for management and maintenance by the Ministry of Transport, Information Technologies and Communications, excluding the following port terminals granted under concession:
The port terminals of the Port of Public Transport Ruse, which are granted under concession, namely: PORT TERMINAL SVISHTOV with Concession Agreement with Decisions of the Council of Ministers: CMS No. 427 of 12.05.2005 (Promulgated SG No. 44 of 2005) and CMS No. 866 of 07.11.2005 (Promulgated SG No. 91 of 2005), as one part of property with identifier 65766.501.158 according to the Cadastral Map of Svishtov with an area of 81,917 sq.m has been granted, according to Annex No. 3 of the contract; PORT TERMINAL SOMOVIT with Concession Agreement with Decision of the Council of Ministers (CMS) No. 233 of 06.04.2009 published in SG, No. 29 of 2009 and PORT TERMINAL NIKOPOL with Concession Agreement with Decision of the Council of Ministers (CMS) No. 286 of 10.05.2013 have a commitment to finance the general plans of their terminals themselves, according to their concession agreements.
f) Deadlines and stages of preparation of the program and the existence, legally regulated, of a requirement for public discussion or other procedural form for public participation
The scope, content, terms and stages of preparation of the “Draft General Plan of the Port of Public Transport Ruse” must be in accordance with the current legislation, including the requirements of the Law on Maritime Spaces, Inland Waterways and Ports of the Republic of Bulgaria, as it is necessary to fully cover the requirements of Ordinance No. 10 of March 31, 2014 on the scope and content, development, approval and amendment of the general plans of ports of public transport, issued by the Ministry of Transport, Information Technologies and Communications and the Ministry of Regional Development, as well as those of the Technical Assignment approved by a special joint Order of the MTITC and MRDPW.
Section V of Ordinance No. 10 regulates the acceptance and approval of the General Plan of a port of public transport.
- Information about the body responsible for the implementation of the program
The body responsible for the implementation of the General Plan of the Port of Public Transport Ruse is the State Enterprise “Port Infrastructure” – Sofia with granted rights for management and maintenance by the Ministry of Transport, Information Technologies and Communications, in accordance with the provisions of Art. 115l, para. 3 of the Law on Maritime Spaces, Inland Waterways and Ports of the Republic of Bulgaria (LMSIWPPRB).
- Body for acceptance/approval/adoption of the program
According to Art. 112a, para. (4) of the LMSIWPPRB – the draft general plan of a port of public transport is accepted by an interdepartmental expert council. The general plan adopted by the interdepartmental council is approved by the Minister of Transport, Information Technologies and Communications and by the Minister of Regional Development and Public Works, after coordination with the Ministry of Environment and Water (MOEW) according to the procedures of Art. 6 of the Environmental Protection Act (EPA).
